All content on the tsurprise.com website (illustrations, photos, articles, product descriptions, comments) is protected as intellectual property. Any reproduction is strictly prohibited without prior permission from JoliBento Inc.
All orders placed on the Site are subject to these General Conditions of Sale. JoliBento Inc. reserves the right to adapt or modify them at any time. The General Conditions of Sale applicable to any transaction is the version found on the tsurprise.com Site at the time of the order.
The Customer declares to be a natural person, at least 18 years of age and has legal capacity or parental authorization to place an order on the Site. The Customer must ensure the accuracy and completeness of the mandatory personal information they provide in the “My Account” section. In case of error in the recipient’s address information, JoliBentoInc. cannot be held liable for its inability to deliver the product. JoliBento Inc. reserves the right to cancel any order should the customer’s IP address reside in a different country from the billing and/or delivery address.
The products offered for sale are those described on the Site. T.Surprise’s objective is to help its Customers discover new products through a monthly subscription. Therefore, the Customer acknowledges and accepts to purchase a product whose specific description is not established fact on the Site at the time of the order. T.Surprise takes great care when presenting and describing the products shipped in previous months to best inform the customer. The customer acknowledges and accepts that it is possible that the site may contain minor errors. In all cases, should the product delivered differ significantly from its description on the Site, the Customer may either exercise the right of withdrawal or invoke JoliBento Inc.’s Corporate Compliance Guarantee, who will proceed, as appropriate, to either exchange the product or provide a refund (in whole or in part) for any amounts billed.
JoliBento Inc. offers different products involving tea, infusions, food products and accessories on its tsurprise.com website related to the theme promoted each month.
The Site(s) operated by JoliBento Inc. are, in principle, accessible 24/7 without interruption, planned or unplanned, for maintenance purposes or in case of force majeure. Being subject to a best effort obligation, JoliBento Inc. cannot be held liable for any damage, whatever the nature, resulting from the Site’s unavailability.
In case of a problem, JoliBento Inc. undertakes to make every effort to restore access to the Site(s) as soon as possible. Disrupted access shall not give rise to compensation.
Once per month,JoliBento Inc. sends its Customers a box containing teas, infusions, food products and accessories related to the theme promoted each month, in order to help manufacturers of these products to promote them and to enable customers to taste, discover and test different tea-related products.
We deliver our boxes of tea throughout Canada, to the Customer’s residence or his/her place of work. It can be delivered abroad for an additional monthly shipping fee of $3 to the United States and $10 to all other international destinations.
It is agreed that T.Surprise reserves the right to suspend tea delivery service for a month, for any reason whatsoever, without being required to provide any notice to the Customer. In this event, if the Customer has a monthly subscription, he will not be charged for the current month’s box. If he has a 3-month, 6-month or 12-month subscription, he will receive the next month’s box during the last month of his subscription and will not be entitled to any refund.
Placing an order on the Site is subject to compliance with the procedure implemented by T.surprise solidified by a succession of different steps that the Customer must absolutely follow to validate his order. The Customer will be able, before finally confirming his order, to verify the details and the total price, and to correct any errors before confirming it to express his acceptance. Any order confirmed by the Customer is a sales contract and implies acceptance of all the provisions herein. If the information provided by the Customer is incorrect or inaccurate, T.Surprise cannot be held responsible and will not compensate for any resulting damage (non-receipt of an order).
The subscription contract between the Customer and T.Surpris is valid as soon as a payment is made or the first month of a subscription is paid, which will result in a confirmation email. Without a confirmation email, no subscription exists and T.Surprise can in no way be deemed liable.
T.Surprise will refuse any order from a Customer with whom there is a dispute or an incident relating to a payment of a previous order or that would contravene the provisions herein.
In this case, T.Surprise will notify the Customer by email. In the event the Customer proceeds against T.Surprise to correct any erroneous or contradictory elements in these General Conditions of Sale, T.Surprise reserves the right to suspend or cancel any subscription.
T.Surprise will send the Customer an email confirmation to summarize the order. For this purpose, the Customer formally accepts T.Surprise’s use of email to confirm the contents of their order.
There are several subscription packages for the tea box delivery service.
In all cases, the customer can subscribe for themself in their own name or give the subscription to a third party. In this case, he needs to indicate that the order is a gift on the initial subscription form and provide the third party’s delivery address.
Each subscription is confirmed to the Customer by email.
Monthly Subscription with Monthly Withdrawals:
By signing up for a monthly subscription, the Customer subscribes to monthly delivery of a box of tea until one of the parties decides to terminate this subscription.
The Customer acknowledges that his subscription to this offer requires a mandatory defined monthly payment and that it is therefore a fixed-term contract.
Subsequent modification of the prices after subscription is not enforceable against him.
The amount of the monthly subscription will be automatically withdrawn from the Customer each month, on the 10th of the month before the box is shipped. The amount for the following month’s box of tea will be withdrawn in the current month. To receive the current box, you must subscribe before 11:59pm (EST) on the last day of the month.
The customer may terminate the subscription at any time under the conditions provided in the “Unsubscribe” Article. By approving his order after checking its contents, the Customer agrees to fully accept these General Conditions without reservation.
Three-Month Subscription with One-Time Payment:
By signing up for a three-month subscription, the Customer will receive a total of three (3) boxes of tea over the following months, which is a box a month for a period of three months from the date the first box is shipped. A one-time payment at the effective rate is made at the time of initial subscription. The Customer cannot unsubscribe from this offer before the end of the term, except for reasons stated in the “Unsubscribe” Article of these General Conditions.
Six-Month Subscription with One-Time Payment:
By signing up for a 6-month subscription, the Customer will receive a total of six (6) boxes of tea over the following months, which is a box a month for a period of six months from the date the first box is shipped. A one-time payment at the effective rate is made at the time of initial subscription. The Customer cannot unsubscribe from this offer before the end of the term, except for reasons stated in the “Unsubscribe” Article of these General Conditions.
Twelve-Month Subscription with One-Time Payment:
By signing up for a 12-month subscription, the Customer will receive a total of 12 boxes of tea over the following months, which is a box a month for a period of 12 months from the date the first box is shipped. A one-time payment at the effective rate is made at the time of initial subscription. The Customer cannot unsubscribe from this offer before the end of the term, except for reasons stated in the “Unsubscribe” Article of these General Conditions.
In the event where T.Surprise suspends the box delivery service for a month, those with 3-month, 6-month and 12-month subscriptions will not be refunded, but will receive a box in the month following the expiry of their subscription.
Orders are done the first and last day of the month, and shipped between the second and 12th day of the following month.
Monthly Subscription with Monthly Withdrawals:
The Customer may terminate his membership at any time without notice between the first day of the month and before 11:59pm (EST) on the 9th day of the month so that the cancellation is effective for the following month. For example, if the Customer no longer wants to receive the box of tea for November, he has between september 15th and 11:59pm (EST) October 9th to unsubscribe and not receive it. If the box has already been paid for, it will be sent automatically, and the subscription will cease after shipment of the last box for which the Customer has already paid.
However, after first signing up, the Customer can communicate with the Site within 30 days to cancel in the first month. To cancel his contract with T.Surprise, the Customer must click on the corresponding link in his personal account on the Site. The cancellation will be confirmed by email.
As this is a fixed-term contract, the Customer cannot terminate his yearly subscription or get any refund, except for the following reason: his location is not covered by the subscription for a duration exceeding 3 months following notification of this absence to T.Surprise, if the three months fall within the 12-month subscription. The Customer must notify T.Surprise. of his decision to cancel the contract via email including valid proof. If T.Surprise considers the termination is warranted, it will refund the Customer within (30) days after receiving the notification, in proportion to the remaining months.
Other subscriptions cannot be cancelled.
The Customer will receive tea-related products. He will receive 4 to 5 varieties of teas, infusions, food products and/or tea accessories. The teas and infusions may be in different formats, like in bags, bricks or loose tea.
T.SurpriseInc. may change the products and services offered for sale on its website at any time, without prejudice to the Customer’s subscription.
Before ordering, the Customer can read about the main characteristics of the products and/or services he wishes to order on the Site. Regarding the monthly delivery service, the Customer expressly agrees to receive a surprise box and will not be aware of the products included in it before ordering. The Customer is fully aware of this and fully accepts the nature of this service.
Photographs, graphics and descriptions of the products offered for sale are for informational purposes only and are not binding upon T.Surprise.
All prices are indicated in Canadian currency, excluding taxes. Shipping costs within Canada are included in the price. The total price of the order, excluding taxes, is indicated in the shopping cart.
T.Surprise reserves the right to change its prices at any time but the products will be billed based on the rates in effect at the time of order, subject to availability.
The Customer must pay the full price when placing the order. Payments will be processed through the Stripe secure platform. Gift orders can also be paid by credit card.
We will deliver to the shipping address provided by the Customer, it being specified that it must be the address of the Customer’s residence or any other person of his choice living in Canada or abroad. We will not deliver to hotels or P.O. Boxes.
To ensure these delivery times are met, the Customer must submit accurate and complete delivery address information such as, in particular: street and building n°, stairwell, access codes, names and/or intercom numbers, etc.
All orders received through the Site will be shipped between the 15th and 20 day of the following month. Times indicated are for information only, corresponding to average processing and delivery times. T.Surprise cannot be held liable for consequences of delayed delivery not of its making.
A Customer has the right to withdraw that he can exercise without reason within (7) days from delivery of the order. He must return, at his own expense, the new products in their original packaging along with the order number. The Customer will communicate with T.Surprise in order to be given the return address.
T.Surprise will refund any amounts already paid to the Customer, with a deduction for any shipping fees, under the conditions referred to in Article VII.
The Customer may email his request to return his box within 7 days after receiving it to: email@example.com
Given that the Customer agrees to receive a surprise box, it cannot be returned except for defective or missing product(s). In this case it will be replaced, while supplies last, or with a similar product of equal value.
The return will result in T.Surprise’s express prior agreement by email to the Customer. The product must be returned, at the Customer’s own expense and risk, within 7 days after receipt of this email from T.Surprise. All of the box’s contents must be returned in their original packaging to the return address provided by T.Surprise. The Customer must have stamped proof of mailing.

All orders imply the Customer’s full compliance with the General Conditions of Sale, which are governed by Canadian law. In case of a dispute, Canadian courts shall have sole jurisdiction. In case of difficulty or to make a complaint about an order, the Customer can contact Customer Service to find an amicable resolution.
Information collected by T.Surprise during a Customer’s order is required to manage the transaction, and as such, may be communicated in whole or in part to T.Surprise’s providers who are involved in fulfilling the order. The Customer is notified that this same personal information may also be collected by an organisation responsible to analyze orders and fight against credit card fraud. The customer has the right to access, correct, oppose and remove his information at any time.
